Orphan Works Act

Orphan Works Act of 2008
http://youtube.com/watch?v=CqBZd0cP5Yc

On April 24, Senators Pat Leahy (D-VT) and Orrin Hatch (R-UT) and Representatives Howard Berman (D-CA), John Conyers (D-MI) and Lamar Smith (R-TX) introduced legislation (S.2913, HR 5889), which is now being referred to as the Shawn Bentley Orphan Works Act of 2008. It is virtually the same bill that was presented in 2006, and subsequently rejected by Congress. But now, they are trying again.

If passed, the Act would radically alter copyright laws, taking away the automatic copyright now guaranteed to artists of all types who create any type of work. Right now, under U.S. law, artists are automatically guaranteed copyright on everything they create, from the sketches in their sketchpad to their best paintings and sculptures. Under the Orphan Works Act, every creator will be required to register everything he or she creates in a private registry system, requiring a fee of course, and supposedly to make it easier for the "public" to search for works and contact the creators if they want to use the works for some purpose.

Everything created in the last 30 years will need to be registered through this as-yet nonexistent system, including those works already registered via additional fees with the copyright office. If they aren't, and some member of the public makes "due diligence" to find the creator of a work and can't find him or her, that member of the public is entitled to use the work without any limitations, and artists will have no legal recourse. That means every piece of work artists have out there, especially online, would be open season for use by major publishing houses and businesses (Microsoft — who owns one of the largest online image databases — and Google have already voiced support for the bill and indicated they will use thousands of images) and everyone in between. Proponents of the bill say it will assist the public in identifying and contacting creators of works and going through the proper channels to contact them to ask for permission. While we understand the need for an organized system of search, there are MAJOR FLAWS in the proposed bill that need to be addressed before any such proposal should take place. Here are a few points:

Under this law, artists would need to register EVERY piece of work they create, including those works that you have already registered with the Copyright Office officially, in some system that does not exist and would likely require them to pay to do so. The time and cost to do this is going to be prohibitive for visual artists.

While this is meant to apply to all types of creative works, including music and literary, visual artists will be impacted the most because of the sheer volume of work they create, making it very expensive to register everything they have ever created or will create.

For the visual arts, there would still be little protection for them and their work, even if it is registered, because search tools would rely on names of artists or titles of work, and not image recognition tools, which are still in their infancy of development.

Under this law, if artists register their work, they would have to respond to EVERY inquiry sent to them for use of the work. So in other words, if an artist has a work out there in a registry system, and some person contacts the artist and says he or she wants to use the artist's work for free on his or her Web site or in his or her new catalog, the artist would need to take the time to officially respond to every inquiry within a specified time limit, letting him or her know if the artist doe not want to have him or her publish the artist's work for free. This will take a lot of time and effort that professional artists do not have.

Last week, the House Judiciary Committee unanimously approved the bill, and yesterday, May 15, the Senate Judiciary Committee did as well. This means the bill will be presented to Congress, likely before the end of May.

We need you to write to your representatives ASAP and let them know that you do NOT want this bill to be expedited, as it is now. Tell them we need a better solution, or tell them you don't want it at all: Just be sure to tell them something soon.

Click the links below to get more information on the bill, including a video that gives you a great overview of the artists' concerns:

sewing with human hair

I'm stuck at part one- threading a needle with human hair.

They are 16" lengths of very fine hair. I figured threading multiple strands would provide enough tension that it wouldn't break when I begin to sew with it. I can't manage to handle the lengths not to mention hold them together to get them through the eye. When I finally do- they all seem to separate and I can't hold them to knot them off.

Does anyone have any tips on how to work with such a delicate process?

that might make a good topic here

1 What type of artwork do you create?

2 Do you consider yourself to be a beginner, intermediate or advanced artist?

3 Have you sold any of your work so far?

4 Does the idea of promoting and selling your artwork intimidate you?

5 Where would you like to be with your art in a year? Five years?

6 Would you like to support yourself with artwork sales and if so What are your selling/marketing goals for the next year?

7 What inspires you as an artist?

8 What stops you cold? Turns you off as an artist?

9 Do you have a website or blog address you would like to share?

The following hyperlink shows a great gallery called Art Ark :http://images.google.com/imgres?imgurl=http://www.theartark.com/2-d-works/artistspics/laing/bl-dusk-2-22x30-serigraph-550.jpg&imgrefurl=http://www.theartark.com/laing.html&h=338&w=250&sz=126&hl=en&start=25&tbnid=_8W2xl8gh0yQbM:&tbnh=119&tbnw=88&prev=/images%3Fq%3D%2B%2522serigraph%2522%26start%3D20%26as_st%3Dy%26ndsp%3D20%26hl%3Den%26sa%3DN%26ie%3DUTF-8

Specifically the section i reference above deals with the astonishing work of sculptor Phil Crawford . I cannot vouch for all the artists at ART ARK but the sculptures he makes ---especially the one's 'continuum ending' and the other one '(continuum origin' ?) are mind-squalling. NOT merely mindlowing but mind squalling !

Lighting for booths with Pro Panels

While I'm not involved in regular festivals, I do have need to display my artwork in other situations and have recently bought some very nice Pro Panels. Lighting I've found on the web seems VERY expensive and I think I could rig something up using short track lights or something from Home Depot. Just can't figure how I'd attach them IF that's the way I go. I bought some clamp lights, but they don't come out far enough from the panel and only illuminate the top 1/3. Any suggestions or links to photos?

Unless my searches here were using the wrong keywords, I didn't see anything about this in this tribe.

2008 Charity Tribal Bellydance calendars now ready!

All calendars are sold in aid of the World Land Trust which is a charity that works to save tropical forests and wildlife. They play an active role in the bid to slow global warming which effects us all. And of course, Sir David Attenborough (one of my heros) is a patron.
See www.worldlandtrust.org for more details.

The calendars are A4 and have a piece of tribal artwork for each month. (These could be framed at a later date).
The artwork has been printed from original oil, acrylic and pastel pieces. There are some previously unpublished work included.

The cost - £7.50 each (+p&p)
Postage/Paypal
UK
1 = £7.50 + 80p Total = £8.30
5 = £37.50 + £2.70 Total = £40.20

USA
1 = £7.50 + £2.90 Total = £10.40 (approx $20.80)
5 = £37.50 + £ 10.50 Total = £48.50 (approx $97)

In an attempt to cut down on postage/paypal charges I've listed the cost to buy 5 at a time. If you would like a different amount, please let me know and I'll find out the cost for you.
If you are from another country, drop me a message and I'll find out the postage cost for you too.
If you pay by cheque, I should be able to reduce the price alittle.

(Also, I have some new Christmas designs ready in about a weeks time. I can post them all together for you to save postage charges. I have afew Christmas cards from last year - see my photos area. Christmas cards go to children's charities).

Please message me for any further information.
Thank you!

Gallerie Icosahedron 2008 Emerging Artist Competition

Gallerie Icosahedron Emerging Artists Fine Art Competition is intended for those who wish to receive exposure in the rigorous New York City art scene and market. We wish to offer fresh talent an opportunity to exhibit in NYC. We are one of the handful of galleries that specialize in Visionary Realism, Surrealism, and Visionary Art in general: however there are no rules to our selection since excellence in art often means breaking all the rules.

The exhibit will run from January 9- January 31, 2008 at Gallerie Icosahedron. Gallerie Icosahedron is a fine art gallery and it has also become a premiere venue for classical and cutting edge contemporary music and performance. Our concert calendar has included luminaries that have performed at the Metropolitan opera and Carnegie Hall. We are hosting a weekly concert series designed to attract audiences interested in Jazz, New Opera and traditional classical music. Art and music lovers are drawn to Gallerie Icosahedron for the excellence of both the visionary art and the virtuosity of the performers. Gallerie Icosahedron is the vanguard of a cultural revolution that will unite both music and art. We believe that creative communication is freedom’s sanctuary. We are a street level art gallery located in the heart of the prestigious Tribeca section in Manhattan, NYC.

The opening reception will include an open bar and we will send invitations and announcement to everyone on our extensive mailing list. The opening will be held on Thursday evening January 10th, 2008, and the show will continue until January 31st, 2008. There will be a musical performance before the opening.

New Store Opening - Artists Needed!

I'm opening a new store here in Evergreen, Colorado - an eclectic mix of artworks from beginning and established artists all over the country, in every medium. Musicians and writers are welcome as well. The store is run by consignment with a twist - you set the price, we make a 40% markup for the comission. We cover taxes, advertising, display, store rent, etc - all you have to do is provide the art, an inventory and price list for your work, and once a month, we will send you a check. Hopefully, we'll contact you more often than that, because your work is flying off the shelves!

If you're interested, please contact me and I'll send you a contract. You can also call me with any questions at 515-865-5111.

The store is set to open October 1st, with a grand opening October 13th.

We will be featuring an artist every month in the store, on the website (coming soon!) and on our myspace page. The myspace addres is: http://www.myspace.com/RavenGlass Gallery

I am also looking for a logo designer for rwasonable cost - I'm looking for a line art drawing of a side view of a raven looking into a mirror - perferabley 18th century design - or holding a hand mirror in his claws while looking into it. He doesn't have to be seeing his reflection, but that's ok if he is. I'd like it right facing. If you have any ideas, run them past me!

Thanks and I hope to see some of your work soon!

Artist Discussion Salon & CELLspace Call to Arms

We have been planning this discussion on arts and media production for some time but it's even more appropriate in the face of what is going on. Keep your eyes peeled for the new Executive Director of Black Rock Arts Foundation, joining us for panel discussion!

Artist Salon and Reception for the Expo for the Artist and Musician
Thursday, September 13th 7:30-10:30
CELLSpace (2050 Bryant) SF

free admission
free drinks and snacks
arts and media panels - discussion and Q&A

live music - visual art show
puppetry workshop(canceled due to CELLspace woes, see below)
sewing class

This salon is part of the lead-in for an astounding event happening at SomArts that weekend, designed to bring artists, musicians, and the people who make it all happen together to meet each other and talk about their work. At CELLSpace we will have an art show in the gallery, puppetry and sewing workshops in the loft, musicians, free drinks and food, and panel discussions. The discussions will revolve around the ideas of producing arts, media, and change from a non-profit and for-profit perspective. What are the benefits of each format? How can artists navigate the world between the two for maximum freedom and maximum funding? Bay Area heavies from both sides of the fence will discuss why they have chosen the structure that they have and how they use it to get what they want.

BREAKING NEWS - CELLspace is facing massive crisis and needs your help! We will give the microphone to someone from the organization who can tell you all about what is going on and how you can get involved. Get your news fresh from the trenches. We love this community resource and want to fight to keep it! http://pandorastrunk.com http://artsandmedia.net/expo

Emerging Artists - Looking to get connected

Hi Artists out there!

I'm an emerging artists, I recently left the corporate world to follow my passions. I've been creating a lot of work, and friends have been giving me kudos, but I still need to find a way to get my art "out there" - I've posted on http://www.myartspace.com/artistInfo.do?populatinglist=home&subscriberid=ijohcsv9r9s9txq2
and did get accepted to a juried artshow Oct 4,5,6 in Sacramento - The merican Festival of Arts, which is exciting.

Any suggestions on where to go to get my work seen? How does one get their stuff up in a Gallery or infront of the eyes of a prospective buyer?

Please take a look at my website at http://www.suzadam.com. I'd love any feedback and or suggestions. Or if you have a contact and could forward on my website that would be great.

Thank you!!

Artistic popular Indie Film- free viewing

Hello artists,

I thought you all might be interested in watching this free independent film that showcases a couple from New York who only communicated through art, and mail art, during their entire relationship. Four Eyed Monsters, I am sure some of you have heard of it through the indie circuit, is full of beautiful animation and aesthetically pleasing editing techniques that make me appreciate it for that alone!

It will only be up for a week here: http://foureyedmonsters.com/watch/

So check it out, read all about their story and if you become a huge fan, buy the film through the “Buy DVDs/Downloads” link... It is all for a good cause- getting the filmmakers out of debt and supporting the indie art community! enjoy!

seeking license / commission work - suggestions ?

Hey, I've been trying to get some more variety in my portfolio to show folks that I'm not limited to just comic strips. I just put this one up last night http://people.tribe.net/water_muse/photos/5aaa1121-7dd1-4f4e-9436-514b6713fa68 and some of my portfolio can also be seen at http://smolderingremains.deviantart.com

I've not had much luck (yet) with finding work as an illustrator on craigslist. I wonder if anyone here has any suggestions of other (or possibly better) places to advertise myself as being available for either licensed or commissioned illustration work?

Thanks :)

Hi…I’m new here…hoping to make some friends. My primary interests are art, new media and environmental stewardship. I’m looking to connect with Digital Artists, to include them in an international touring art exhibition called Common Ground www.commonground2008.com. The theme for each piece in the collection will be about the Environment. We launch our exhibition in Beijing to coincide with the Olympics in 2008, then on to cities in Europe and the Americas in 2009 and 2010. Would love to hear from you and support you any way that I can. Please join my community of friends and our tribe, Common Ground 2008. Peace.

Hey Folks,

This Friday, March 9th is the second opening for the group art show
I'm curating called "Whimsy, Terror, and Speculation. " This time it
will feature the work of Jose Lopez, Alex Schaefer and myself. Both
Alex & Jose's work is really amazing (& mine is ok too).

It's at the Stephanie Feury Studio 5636 Melrose ave. (1/2 block east
of Larchmont in Hollywood)
The opening is 6:30 to 8pm this Friday.
At 8pm is the the play "The Empty Bed" by Sharon
Yablon which takes place in the theatre.

What you've got is two great events rolled into one. Theatre and the
visual arts together as they should be. It will be very fun. So, get
your ass down there!

Any composers of music want to collaborate?

Outside standard framework
a world of my own
imagining
defining
glory and grace,
a realm of faith not attuned
to the dictates of deity or demon.
I live in faith that my fate
reflects my deepest values
my truest cause
my unseen vision
and move mountains into place
to catch the rays of
my rising star.

Smelling flowers
Seeing colors
Hearing music
Feeling liquidity of motion
What more could any desire?
What food could better fill?
What relationship resemble
no veil, no intermediary
Direct experience of bliss

Shadow world.
Deep in the gorge of my pleasure
unearthly magnificent treasure
deeper than bones
more ancient than stone.
Calling me home
my one true friend
my Peter Pan
affixed to the tip of my toe.
You are the world that says I'm true.
Opening beyond my face
into a place molded of starlight,
changing as the phases
of the Moon
into a way of seeing
I won't let me see too soon.

Jesus, save us.
I hear the tortured call.
Cool, clear potent water
will save us all.

You're not my blessed flock
You're not my progeny
If you think this all a crock
Well, my blessings on thee.
All I am saying,
all that I wish to impart
Is: it's never enough to
follow your heart.
Find a path
that will set you free
to follow a dream
down through a rabbit hole
or up to the stars.
Don't let your day job define you.
Open your arms
and fly.

You are invited to join the new Earth Art Tribe!

This tribe is devoted to imagery involving digital transformations of satellite photography of the earth's surface -- a radically new artform never before possible in the history of humanity! Post your work, comment on others' work, discuss issues relating to techniques, sources, precedents, and the implications of creative appropriation in the age of digital information and communication.

We already have more than 500 images to view in our photo album, many linked to original source photography.

KLab9 Call for Contributions

KLab9 Call for Contributions
From KnowledgeLab
KLab9:Art - Technology, Authorship and Ways of Living
A weekend gathering for collaborative and creative reflection. 5th - 7th October, 2007 tbc.
Institute for Advanced Studies, Lancaster University, North West England.

INTRODUCTION

The Knowledge Lab is an attempt to provide a collective space for anti-capitalist reflection. It is located at the margin of the university, an institution essentially geared towards the production of knowledge as a resource for corporate interest and as justification for particular constellations of power relations.
This knowledge lab will address art and ways of critically thinking about our world. Within this broad region of enquiry, the lab will encompass notions of life and art as a political commitment, the influence art can exert in politics and how political ideas in turn influence art. It will also address new ways of making art and how this relates to technologies and social changes, and the use of art as an anti-capitalist means to change and fight the system.

We hope that the knowledge lab will not merely address, but also show that art can initiate critical thinking in the various guises outlined above. Our expectations, in terms of the event, and its outcome, are that this be a sharing of creative ideas and ideas about creativity. We hope that it will draw together people with a common interest in art and alternative ways of living, but working in different fields. From this collective thinking we hope that people will be incited to realize, or make manifest, some of these ways of living and thinking creatively when they leave: We will learn from each other.

STREAMS

Like previous knowledge labs the day will be divided into four streams, each will take place in a separate room.

STREAM 1: TECHNOLOGY Free software, art spaces and interfaces, hardware, DIY and recycling/reusing.

STREAM 2: WAYS OF LIVING This stream concerns process, moment and performance. It is the political stream where we will consider primarily imaginative resistance and artivism, but also touch on debates surrounding gender issues, community and cultural production, and personal/political. We hope to see papers touching on initiatives in direct democracy; the art of changing that system, and the paradigms of inspiration. We would like to discuss how artivism will change society, possibles networks of artivists, ways of action.

STREAM 3: AUTHORSHIP Copy rights, ownership, patenting, and appropriation. (Creative commons, Copyleft,...)

STREAM 4: THE ART MARKET (new ways of) curating, spaces (physical and virtual) to show art, ways of making money: Marketing, the means of production, market forces and anti-market forces, the art market, and art and ethics.

CONTRIBUTIONS

Each day will be split into two parts. On Saturday and Sunday morning papers will be presented in each of the four streams, each lasting 20-30 minutes. Papers will be followed by a brief question period of 10-15 minutes. The afternoon will be divided into discussion periods in each of the four streams. During the weekend there will also be a separate space for workshops and performances.
There are therefore a variety of ways to contribute to the weekend. See below for details:

ACADEMIC PAPERS

The list of streams is not prescriptive, it simply outlines some of the issues we envisage arising given the general themes.

Please also send papers on other themes, these will be gratefully considered.

Submit an abstract of no more than 500 words. In addition please enclose a brief biography. Try to make this, along with your paper, as accessible as possible.

FACILITATED DISCUSSIONS (INVOLVEMENT AND SKILLS SHARING)

If you have an idea for one of the afternoon discussion topics that links in with one of the four streams then send in a your idea and think about one of the two types of involvement below:

If you'd like to take a more pro-active role during the conference, you might want to ADOPT a session - that is, prepare it in advance (suggest questions, main issues, reading material etc and propose the length of the session), arrive prepared for discussion themselves, attend it, and participate passionately in the debates.

We also need people to FACILITATE sessions - ideally a session should NOT be adopted and facilitated by the same person(s). Consider that facilitators are usually best if experienced in their task. Any which way, please get in touch.

== WORKSHOPS, ARTWORKS, AND PERFORMANCES ==

These will broadly tie in with one of the four streams above. Send a proposal [Max: A single side of A4], elaborate on: What your contribution will be e.g. a workshop, a performance, an artwork. How long you envisage it taking. Do you need any equipment or materials? Do you want to limit the number of participants? If so, how many? What do you hope will be born out of this? How do you propose to arrive at this end?

SATURDAY EVENING

DJ and VJ session: Call for DJs and VJs to send in samples so they might come and contribute to an evening of art in many guises. As well as other music, visual, perfomance, etc artist and Artivist.
Nb. Groups are welcome to contribute workshops, materials for display and/or distribution.

INFORMATION

Anybody is welcome to attend the weekend, get involved in the discussions, and take part in the workshops. HOWEVER, YOU NEED TO REGISTER TO ATTEND AS THE EVENT IS LIMITED TO 100 PEOPLE, SO PLEASE GET IN TOUCH: klab9art@googlemail.com

Greetings All
Have just re-located to Bay Area (Polk & Post) this is my 3rd and hopefuly last residency here. Originally from the Snow capped Mountains of Utah ... (Brrrr). Many co-factors exist for this move but as the song implies, "My heart has always been in San Francisco" Ive left it twice but never again. I miss the diversity the most. Too long have I undured with those who live beyond the statistical Bell Curve. Happy to be back.

Have been diagnosed with DVT (Deep Vein Thrombosis) and subsequently PAD (Peripheral Artery Disease). Presently take Coumadin - an anti-coagulant. Corrective Surgery has been scheduled at St. Mary's for 3/14. Acquired a Support Tag for my dog, "BABE" who has been trained to pull me up and down these hills in the City.

Am devout Radical Faerie, founder of Utah R.F. and still owner of Tattoo Parlor in Salt Lake City. Am LQQking for work in diferent feild. Have no trade nor expertise outside of Tattooing and the Arts. CCSF Alumni 2001 - Associates of Arts - Creative & Visual Arts - Any help would be appreciated.

Plan to Tattoo at Cow Palace Expo on March 30th with Parlor in San Bruno

Thank-you

needing a solution

I have an idea, but I need something that looks like cotton candy but will withstand basic wear and tear- at least a bit.

Of course, the best solution is fiberglass insulation - but for part of a costume? I think not.

I'm considering cotton or silk rovings, but I don't want to get too expensive.

Any suggestions?

Hello members of this Tribe,
I joined a few days ago and wanted to get things going by asking if you would view my profile,my artwork, and if interested, send me a friend invitation. My main purpose in joining Tribe is to meet other artists for artistic communication. I have added two links in this post to images of my Dream Matter artwork.
Thanks....Steve

Inexpensive fine art quality archival digital printing of your artwork - on an Epson 9800 wide format printer

I have an Epson 9800 pro digital inkjet printer available at very low rates, often 1/2 to 1/4 as much as service bureaus charge, and am interested in working with photographers and artists to print images of their work.

Many are familiar with the fine photo and fine art papers available, but many are not yet very familiar with printing on canvas. Your artwork can look superb on canvas as well, and the results are archival.

You can increase and extend the exposure of your work with accurate and long-lasting prints on many media including aluminum, vinyl and silk. It's possible to make more from selling prints than in selling originals, and you can do both.

If you are interested in printing at a fraction of the retail costs out there, please contact me. For example if your files are ready to go there is no setup fee, and printing on papers is $6.50/square foot and $8.50 for canvas. I am located in Oakland, CA and would enjoy talking with you more about it and helping you to get to where you print what you want, as few or as many as you want, when you want.

Thanks a lot, I look forward to working with you!

Beginning in March next year, we are inviting 9 people to cruise from Bodrum, Turkey along the Turkish coast, Cyprus, Athens, Alexandria on a share expenses basis (very, very inexpensive). We began a documentary in Paris and Turkey last year, and now as it gets warmer in Turkey we are going to complete it. We have a US distributor, and everyone involved will share in profits. It could be quite profitable for you and a real life changer. We are in pre-production of three others...one on black jazz in Paris after WWII until now. We have a Turkish captain/crew/cook on our 70' Gulet, 6 double staterooms still available, all with their own head (toilet and shower). Qualifications? Simply to be able to get along with people. Age? Our producer is 60, our editor is 25. Age inmaterial if you are young in spirit. If you have video experience (HD MiniDV PAL and Final Cut Pro, writing) all the better, but we are doing this to perhaps expand the focus of our documentary which is based on the mystical aspects of Alexander the Great - Title: Force of Evidence. Creative people get free reign as long as they don't sink the ship or the project. We are interested to add some human interest...profound, provocative, funny...to the program, so film making experience in not a requirement. Come for a week or two months. Email me for details.

Hey everyone,
I'm working on a project that requires several hundred audio cassette tapes (yes, those clunky objects that held our music in the days before iPods, CDs and .mp3 players).

I know a lot of people have a stash of old tapes in a box in the basement that they've forgotten about. Why not get rid of the tapes and donate 'em to a good cause?! I will recycle the tapes (via true recycling, not downcycling) and use them as part of my upcoming album.

If you or anyone you know is interested, send me an e-mail or visit http://www.myspace.com/glasshopper for more info.

Thanks!
